Do You Need Probate Before Clearing a House?

This is one of the most common questions we're asked by executors, and the honest answer is that it depends on the specific estate – so this is general information, not legal advice, and you should check with the solicitor handling the estate if you're unsure.

Why it matters

Generally, an executor shouldn't dispose of or sell estate assets before probate is granted, because legally they may not yet have the authority to do so. However, many executors choose to get a clearance quoted and arranged in advance, so the work can go ahead as soon as probate comes through.

What we can do in the meantime

We're happy to visit a property, discuss what's involved, and provide a quote well before the clearance itself takes place. That way there's no delay once you're ready to proceed.

Working with solicitors

We regularly work alongside solicitors and executors, providing documentation for the estate's records and keeping valuables and paperwork safe during the clearance. See our probate and estate clearance page for more detail, or get in touch to discuss your situation.
